If you are arrested and booked on suspicion of drinking under the influence, the first thing that will happen is that you will be taken to the police station. There you will get your mug shot taken and get fingerprinted.
Some states have laws that require you to take DUI course and be held for a period of time. However, other states allow you to be released if someone pays your bail.
After your arrest, you will be given a ticket that tells you your date to appear in court. While you can deny the charges and plead not guilty, this probably won’t end in your favor. The judge and courtroom will see that you failed the sobriety test.

What Are the Consequences of Getting a DUI?
Even if you are a first-time offender, your sentence will include loss of driving privileges for a set period of time. Most states will prohibit you from driving for six months to a year. If you’re lucky, your state may even offer a hardship license that allows you do drive to work or school.
Another consequence of getting a DUI is having to pay a fine. All states have different laws setting the minimum and maximum fine for a DUI. In addition, those penalties can be enhanced depending on the circumstance.
For instance, if property was damaged or if a child was endangered as a result of your driving under the influence, the fines may be increased. Also, you may have to pay court fees along with these fines.
Can You Go to Jail for Getting a DUI? States have different laws regarding jail time for a DUI. For first-time offenders, some states require you to spend a day or two in jail. For repeat offenders, the jail sentence is longer than a few days.
What Are the Probation Terms?
The terms of your probation are determined by the sentencing judge. If you don’t meet the terms of your probation, you could be sent to jail. Your sentencing judge may also require you to attend a drunk driving school or undergo alcohol evaluation.
